About this deal

Sou is the protagonist of the novel, and majority of the story is told from his perspective. He finishes moving to Unit E-9 in the "Freuden Tobi" apartment building shortly before starting a new semester as a third-year student in Junior High School (equivalent to grade 9 in North America). For almost three years since September 1998, Mr. Akazawa (Haruhiko Akazawa) and Mrs. Akazawa (Sayuri Akazawa) have been taking care of him in their custody after he was driven out of his Hiratsuka family home. To ensure that the dwelling is fit for human habitation at the time the lease is granted or otherwise created or, if later, at the beginning of the term of the lease; and Also, none of them appear in the live-action film. However, there's a character with some similarities with Takako. Another 2001 centers around one fourteen-year-old boy going by the name Sou. Hiratsuka Sou. Considering a lot of personal family issues, he hates being called 'Hiratsuka' so a majority of the characters refer to him by his given name (aside from teachers, adults, unfamiliar students, or strangers). You'll learn that Sou has a lot to him to his personality to personal issues to trauma and PTSD from past events in his life. He's a very complicated character, but he's very mature, reserved, and introverted. He cares for others, but he doesn't tend to let that show so bluntly, or he does it and doesn't think much of it; being kind is sometimes a reflex to him that he doesn't realize is stepping out of the way to help somebody. In addition to that, it might be because of his struggle to show emotions. If he doesn't care, he simply doesn't! Sou is very simple, but at the same time, not. However, intervention firstly came via Occupier’s Liability Act 1957 section 4, where in essence a landlord owed a common duty of care to visitors or those who had goods on the premises where the landlord was under an obligation to repair the premises. Due to the practical constraints of the tenant (not the visitor) being required to give the landlord notice of the relevant defect, this in turn was repealed by DPA 1972 section 4.Another (下)" (in Japanese). Kadokawa Shoten. Archived from the original on June 3, 2016 . Retrieved August 18, 2023. The claimant’s appeal to the Court of Appeal was allowed. In contrast to the requirement for actual or constructive notice to have been given to the landlord in claims under LTA 1985, it was ruled that the claimant was relieved of that obligation in claims under DPA 1972. The Court ruled that it simply had to be shown that there was a failure on the part of the landlord to “take such care as is reasonable in all the circumstances” to see that the claimant is reasonably safe from personal injury, with this duty being owed if the landlord “ought in all the circumstances” to have known of the relevant defect. Material time” means the earliest out of the following: when the tenancy commences; when the tenancy agreement is entered into; or when possession is taken control of the premises in contemplation of the letting (if the tenancy was entered into before the commencement of DPA 1972, then the material time will be the commencement of the Act itself).

We follow Sou Hiratsuka, who first appeared in Episode: S. After being placed into the cursed Class 3 of North Yomi Middle School, he is forced to work with a survivor of the first book's events, Mei Misaki, to prevent the Final Destination-esque disasters from unfolding throughout the year. The Honkaku Mystery Writers Club of Japan". Honkaku Mystery Writers Club of Japan . Retrieved July 18, 2015.In the original novel, Kouichi was a target of bullying at his previous school in Tokyo due to his last name "Sakakibara" being the same as a real life middle school murderer from Kobe. On the other hand, he shows a slight cruelness to Mochizuki. In the manga, when Reiko asked him about the club he was joining in his previous school, he replied by saying 'Cooking Club'. Because of his father who can't cook, he has to cook for his family. For Sou, he ends up volunteering to be this "non-exister." He knows that he will be able to survive. Because as a "non-exister," Sou has a very important job. He is not allowed to speak to his classmates nor his teachers on school grounds and/or during school hours.

There is one thing I particularly liked in 2001, which wasn’t elaborated much in Another, is (spoiler: Another) how memory manipulation is operated. Can’t explain too much without spoiling but it’s certainly intriguing. Also considering (spoiler: Episode S), the protagonist’s history that he already has his fair share of psychological issues with memory and such. It gives an edgier touch to the story, if not more psychedelic and trippy. Note their is a title between Another, and Another 2001, called Another S/O that I didn't read. However, the events of that novel are referenced but never explained in this book. I felt I had a little gap of knowledge that impacted more on the main character than on the story. Relevant defect” is vaguely defined as: “a defect in the state of the premises existing at or after the material time and arising from, or continuing because of, an act or omission by the landlord which constitutes or would if he had had notice of the defect, have constituted a failure by him to carry out his obligation to the tenant for the maintenance or repair of the premises”, with each alleged defect needing to be considered on a case-by-case basis.

Once the implied obligations are in play, we then move onto whether there is disrepair. It is a simple, but important point: the obligation only arises where there is actual disrepair. After he asks Yukari where Mei was, she acts as if she doesn't know what he's talking about, but he sees her on top of the roof and runs up to meet her. He asks her some questions, but she rejects them saying that she hates being questioned. She turns around and tells him good-bye. In later episodes, Kouichi asks around the class for info about the class' curse, but no one was willing to tell him. There is a distinction regarding what would constitute sufficient notice between claims brought under LTA 1985 section versus those brought under Defective Premises Act 1972 section 4, which I will explore in my next article on this topic (although readers are referred to Harry v Sykes and another [2001] QB 1014 for an initial exploration of said distinction).

If and once a claimant has successfully navigated the various hurdles set out above, the next step is determining what they are claiming for. Another follows Sou Hiratsuka a fourteen year old boy who hasn't had the best life and is now in the Cursed classroom of North Yomi, a middle school in Yomigaoka. Legend says that in 1972 a young man died and instead of facing his death his classmates and even his teacher pretended that he simply never died. By not facing his death they created the "calamity" that now stalks the students of Class 3 Room 3. Every few years an "extra" person appears in the classroom, one who has already died, and wreaks awful vengeance on the living killing their "fellow" students and family members through series of gruesome and terrifying accidents. Sou and his friend Mei however are dedicated to ensuring the calamity never even starts. Unfortunately no matter how hard they've tried to stop it people start dying.Junta Nakao says that he'll go and get it, but goes limp. Kouichi and Katsumi try go to save him, but can't because a speedboat comes out from behind the mountain. All the circumstances” is general and case-specific: for example, in Rogerson v Bolsover District Council [2019] EWCA Civ 226 it was ruled that the landlord was liable for injuries caused by inadequate inspections of the tenant’s garden.
