About this deal

I have been playing and enjoying the game of golf for more than fifty years. I finally decided to start a golf ball collection. You can start a golf ball collection too. I store my collection of golf balls in a plastic collector’s box that I got at the Container Store after they had been entered in my notebook. In the mid-19th century, most people could only dream of playing golf. There were at the time fewer than 20 golf clubs around the world, with just three being outside Scotland. The 1990 patent with 492 dimples was a continuation of an application originally filed Jan. 14, 1986. Since a patent application must be filed within one year of the invention, the earliest date for this invention must be about Feb. 1985. Therefore I was not surprised to see Spalding golf balls with 492 dimples on the June 1985 USGA conforming list. Spalding golf balls that have this 492 dimple pattern on the June 1985 list are: Top-Flite 492 Spalding USA, Top-Flite Plus Spalding 492, Top-Flite Plus Spalding 492 (orange cover), and Top-Flite Plus Spalding 492 (yellow cover). These golf balls continue to appear on the USGA lists every year until 1993. A fifth ball with 492 dimples, Top-Flite Spalding 492 with logo, appeared on the USGA lists from 1988 to 1993.

In the advertisement the TOP-FLITE II golf ball dimple pattern was called the ‘422 hex dimple design’. This golf ball produced the ‘LOW TRAJECTORY flight pattern’ which gave extra roll. I do not have this golf ball in my collection. However, from the USGA list I discovered that from 1990-1993 a TOP-FLITE II logo Spalding golf ball with 422 dimples appeared. This dimple pattern was designed so that the ball would have aerodynamic symmetry in flight regardless of its position on the tee or the ground. Since this patent was filed Jan. 18, 1991, the earliest date for introduction of this golf ball was February 1990. The Spalding patent 4,880,241 was filed in April 1988. To be valid, a patent must be filed within one year of the date of the invention. This means that this dimple technology was invented by about May 1987. A patent must be novel, useful, and not obvious. This dimple pattern on this golf ball had never been disclosed before, so it was novel. It was useful because this particular dimple pattern wouled travel farther than other golf balls. It was not obvious that this dimple pattern would do this. This new Spalding dimple technology was important because Spalding and Acushnet Companies had spent considerable time in court from 1981 to 1990 hashing out patent issues 5. Spalding had obtained a patent on a new cover material called Surlyn® in 1974 and had sued Acushnet for infringing and won. Acushnet filed an appeal and sued Spalding over patent violations regarding golf ball dimple patterns, fluorescent ball covering, and golf ball moldiing. Finally in 1990 the two companies settled their differences and agreed to cross license their patents.
